1. About Us Banc De Plage is a trading name of C H Phillips Holdings, a UK sole trader. You can contact us at chphillipsholdings@gmail.com.

2. These Terms By placing an order with Banc De Plage you agree to these terms. Please read them carefully before purchasing. If you do not agree with any part of these terms you should not place an order.

3. Our Products Banc De Plage sells clothing and accessories sourced from third party suppliers. All fibre compositions are as stated on product listings and physical garment labels. Care instructions are provided on garment labels. We take reasonable steps to ensure product descriptions are accurate and that all garments meet UK textile labelling requirements.

4. Product Descriptions We make every effort to display and describe our products accurately. Colours may vary slightly due to individual screen settings and lighting conditions. Product images are for illustrative purposes only. Sizing is as stated on individual product listings. We reserve the right to modify product specifications without notice.

5. Age Restriction Our products are intended for adults aged 18 and over only. By placing an order you confirm you are at least 18 years old and are legally capable of entering into a binding contract.

6. Orders We reserve the right to refuse or cancel any order at our discretion. In the event we cancel your order you will receive a full refund. Once an order is placed you will receive an email confirmation. This confirmation does not constitute acceptance of your order - acceptance occurs when your order is dispatched.

7. Pricing All prices are shown in GBP and include VAT where applicable. We reserve the right to change prices at any time without notice. Changes will not affect orders already placed and confirmed.

8. Delivery We aim to dispatch orders within 3-5 business days. Delivery times are estimates only and we cannot guarantee specific delivery dates. We are not responsible for delays caused by third party couriers, customs, or other circumstances beyond our reasonable control. Risk in the goods passes to you upon delivery.

9. Third Party Fulfilment Products are fulfilled by third party suppliers. While we take reasonable steps to ensure product quality and accuracy of product information, we cannot be held responsible for manufacturer defects beyond our reasonable control. In the event of a defective product please contact us and we will work to resolve the issue promptly.

10. Returns and Refunds Please refer to our Returns Policy for full details. You have the right to cancel your order within 14 days of delivery under the Consumer Contracts Regulations 2013. Items must be returned in original condition, unworn and with all original packaging. Return postage is the responsibility of the customer. Refunds will be processed within 14 days of receiving the returned item.

11. Faulty or Incorrect Items If you receive a faulty or incorrect item please contact us within 14 days of delivery at chphillipsholdings@gmail.com. We will resolve the issue at no additional cost to you in accordance with your rights under the Consumer Rights Act 2015.

12. Sizing Sizing guidance is provided on individual product listings. As our products are sourced internationally, we recommend reviewing the size guide carefully before ordering. We cannot accept returns solely on the basis of sizing if the correct size was ordered as per the size guide provided.

13. Consumer Rights Nothing in these terms affects your statutory rights as a consumer under UK law including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. If any provision of these terms conflicts with your statutory rights, your statutory rights shall prevail.

14. Liability To the fullest extent permitted by law, Banc De Plage shall not be liable for any indirect, incidental, special, or consequential loss arising from the purchase or use of our products. Our total liability to you in respect of any claim shall not exceed the price paid for the product in question. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

15. Intellectual Property All content on this website including but not limited to images, product descriptions, copy, logos, and branding is the property of Banc De Plage and may not be reproduced, distributed, or used without prior written permission.

16. Force Majeure We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control including but not limited to postal or courier delays, supplier issues, natural events, or technical failures.

17. Dispute Resolution In the event of a dispute we will attempt to resolve the matter informally in the first instance. Please contact us at chphillipsholdings@gmail.com before taking any formal action. We will endeavour to respond within 5 business days.

18. Governing Law These terms are governed by the laws of England and Wales. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales.

19. Changes to These Terms We reserve the right to update these terms at any time. The current version will always be available on our website. Continued use of our website following any changes constitutes acceptance of the updated terms.

20. Privacy Your personal data is collected and processed in accordance with our Privacy Policy, which is available on our website.
